Required Documents and Information for Patent and Utility Model Applications via the Paris Route

Required Documents

  1. Specification, claims, drawings, and abstract
  2. Power of Attorney (POA)
    The POA can be submitted at a later stage, within a 2-month period from receiving the receipt of an official Notification of Correction. For General POA, only original paper copy will be accepted for recordation, while for seperate POA, electronic form of the POA is sufficient for filing.
  3. Certified Copy of the Priority Document or DAS Code
    A copy of the priority document (or the DAS code) can be furnished at a later stage, provided it is submitted within 16 months of the earliest priority date.
  4. Assignment of Priority Rights
    This document is mandatory in cases where the applicant(s) in the subsequent application differ from the applicant(s) of the basic priority application by way of addition or change. It is not necessary if the applicants are identical or reduced in number. A late submission is permissible within 16 months of the priority date.

Required Information

  1. The name, nationality, and address for each applicant
  2. The name and nationality for each inventor (For Chinese, Japanese, or Korean nationals, their name in Chinese characters should be provided)
  3. The details of the priority application being claimed, including the name(s) of the applicant(s), the official filing date, and the corresponding application number.

Required Documents and Information for Entering the Chinese National Phase via the PCT Route

  1. PCT Publication or PCT Application Specification, International Search Report (ISR), International Preliminary Examination Report (IPER), Article 19 Amendments, Article 34 Amendments
  2. The full name, nationality, and address for each applicant
  3. The name and nationality for each inventor (For Chinese, Japanese, or Korean nationals, their Chinese name in Chinese characters should be provided)
  4. Power of Attorney (POA)

Documents and Information Requireded for filing Design Applications in China

  1. Drawings or photographs of the article to which the design is applied.
    For an article with six surfaces: Six orthographic views (front, rear, top, bottom, left side, and right side).
    For an article pertaining to one or several surfaces: Front view(s) and perspective view(s) of the relevant surface(s).
    For a planar design pertaining to one surface only: Front view of that surface.
  2. The full name, nationality, and address for each applicant
  3. The name and nationality for each designer (For Chinese, Japanese, or Korean nationals, their Chinese name in Chinese characters should be provided)
  4. The details of the priority application being claimed, including the name(s) of the applicant(s), the official filing date(s), and the corresponding application number(s).
