Required Documents and Information for Trademark Application

  1. Applicant's Details
    Full name and detailed address in both English and Chinese characters.
  2. Goods/Services Specification
    International Class(es) and the precise list of goods or services.
  3. Trademark Image
    Clear digital image file of the trademark.
  4. Power of Attorney (POA)
    Mandatory upon filing. Late submission is NOT accepted.
    A scanned copy (electronic data) is acceptable.
  5. Applicant's Identity Proof
    For a Company: Certificate of Incorporation or equivalent business registry document.
    For an Individual: A copy of the passport.
    Scanned copies (electronic data) are acceptable.
  6. For Priority Claim (if applicable)
    a) Priority Information: Priority date and priority application number are mandatory upon filing.
    b) Priority Document: A certified copy of the priority application can be submitted later, within 3 months from the Chinese filing date.

    For an Individual: A copy of a government-issued ID (e.g., passport).

  3. Preliminary Evidence of Status
    Documentary evidence preliminarily demonstrating that the Opponent is a prior right holder or an interested party (e.g., owner of an earlier similar trademark, or a business partner/ licensee affected by the opposed mark).
  4. Critical Deadline:
    The opposition must be filed within 3 months from the publication date of the trademark.

Required Documents for Filing a Non-use Cancellation Action

  1. Power of Attorney (POA) from the Petitioner
    Mandatory upon filing. Late submission is not permitted.

  2. Proof of Identity for the Petitioner
    For a Company: Certificate of Incorporation or equivalent business registry document.

  3. Preliminary Investigation Evidence of Non-use for Three Consecutive Years
    The evidence should include, but is not limited to:
    a) Basic information of the trademark registrant against whom the action is filed.
    b) Findings from an investigation into the use status of the subject trademark.
    c) Evidence from online searches:
    Conduct searches on no less than three (3) different search websites.
    For each website, submit full-screen, consecutive screenshots of the first five (5) result pages from the search.
    Each screenshot must clearly display the search date/time, the name of the search website, and the keywords used.
    d) Status of other trademarks owned by the registrant of the subject trademark.
